BNS Section 74- Assault or Criminal Force with Intent to Disrobe

Bharatiya Nyaya Sanhita (BNS) Section 74 specifically addresses situations where a person uses force or assault with the intention of disrobing a woman. It criminalizes acts that are meant to humiliate, violate, or strip a woman of her dignity in a physical or public manner.

What It Covers:

This section applies when:

  • A person uses criminal force or assaults a woman
  • With the intention of removing her clothes, either partially or fully
  • Or abetting (helping or encouraging) someone else in doing so

Such actions are seen as a severe attack on a woman’s privacy and modesty, and are treated with strict legal consequences.

Punishment:

  • Imprisonment: Not less than 3 years, which may extend up to 7 years
  • Fine: Can also be imposed by the Court

Why It Matters:

This law acts as a strong deterrent against acts of public shaming and physical violation, particularly in cases where women are targeted during protests, domestic conflicts, or public disputes. It upholds a woman’s right to physical integrity and respect.
